Greater Accountability Would Help Ensure That Districts Comply With All Aspects of the Law

Audit Recommendations Disclosure
When an audit is completed and a report is issued, auditees must provide the State Auditor with information regarding their progress in implementing recommendations from our reports at three intervals from the release of the report: 60 days, six months, and one year. Additionally, Senate Bill 1452 (Chapter 452, Statutes of 2006), requires auditees who have not implemented recommendations after one year, to report to us and to the Legislature why they have not implemented them or to state when they intend to implement them. Below is a listing of each recommendation the State Auditor made in the report referenced and a link to the most recent response from the auditee addressing their progress in implementing the recommendation and the State Auditor’s assessment of auditee’s response based on our review of the supporting documentation.
Recommendations to the Legislature
Recommendation 1
If the Legislature wants greater consistency in CHYA instruction related to LGBTQ+ bodies and relationships, it should amend CHYA to require districts to include more specific information and to integrate the information throughout instruction and materials.

Recommendation 2
To increase the likelihood that teachers provide instruction that complies with CHYA, the Legislature should amend CHYA to require teachers to receive regular training on CHYA’s requirements and the scope of what must be covered.

Recommendation 12
If the Legislature wishes to better position school districts to select instructional materials that comply with CHYA, it should require CDE to at least biennially publish on its website reviews of commonly available instructional materials that contain the following:
- A compliance score demonstrating how closely the materials align with CHYA.
- Information about what content is noncompliant or missing from the materials.
- Guidance explaining how school districts could supplement the materials in order to
comply with CHYA.

Recommendations to Rocklin Unified School District
Recommendation 3
To improve compliance with CHYA, Rocklin should perform a detailed review of CHYA’s requirements and amend or supplement its instructional materials so that it addresses all required topics. Further, Rocklin should annually review the information in its instructional materials to ensure that it is accurate, up-to-date, and complies with any changes to state law.

RUSD purchased the most recent updated version of Positive Preventions Plus curriculum. In addition to purchasing updated curriculum, all teachers who teach CHYA are participating in free training provided by California Prevention Training Center. Finally, RUSD was selected for 10 Federal Program Monitoring (FPM)programs; Comprehensive Sexual Health Education is one of the 10. RUSD is currently working closely with CDE to demonstrate compliance with this program.

Rocklin has taken steps to update its instructional materials, but has not demonstrated that its new materials address all CHYA-required topics. Furthermore, Rocklin has not yet developed a process to update its instructional materials to comply with any future changes to state law.
6-Month Agency Response
In addition to participating in the state audit of the CHYA, RUSD was also selection for Federal Program Monitoring in 10 areas; one of those areas was on the California Healthy Youth Act. RUSD has worked closely with the reviewer for the FPM to comply to all the required areas demonstrating our compliance to the program. As part of the process RUSD purchased the 2025 version of Positive Preventions Plus curriculum. The previous version being used was from 2016 and was out of compliance. We currently have two areas of the FPM where we have not be signed off, but this is only as we have not yet completed the teaching of the CHYA in 7th and 9th grade as this is one of the last units of the year.

Although Rocklin has updated its instructional materials, it has not demonstrated that it has performed a detailed review of CHYA’s requirements to ensure these new materials include all required topics. Rocklin’s selection for a California Department of Education Federal Monitoring Program review does not constitute the district performing its own review to ensure its materials are compliant. Rocklin asserts it has taken steps to ensure it reviews Legislative updates on an ongoing basis so it can update instructional materials as necessary.
Recommendation 8
To ensure that it periodically trains all school district personnel who provide CHYA instruction, Rocklin should adopt policies and procedures that do the following:
- Define the frequency and content of training for teachers who provide CHYA instruction. The defined frequency should ensure that teachers receive timely training on the most recent, medically accurate information and that no teacher provides CHYA instruction without having first received that training.
- Track compliance with the required training.

As part of the most recent FPM, all teachers who teach CHYA have been asked to complete the free Comprehensive Sexual Health Education training provided by the California Prevention Training Center. This includes teachers from the middle and high school level as RUSD teaches CHYA in 7th grade Science class and in 9th grade Health class. All teachers are scheduled to have this completed with proof of certificate by the end of January 2026.

Rocklin has adopted a policy to train teachers who provide CHYA instruction every three years, which also specifies that any newly hired teachers must complete training prior to providing CHYA instruction. However, it has not demonstrated how it will track compliance with the required training on an ongoing basis.
6-Month Agency Response
As part of the Federal Program Monitoring for the CHYA all teachers completed the Sexual Health Educator (SHE) training program. This is a training program for California educators and all teachers received a Certificate of Completion. Per the FPM reviewer, teachers will need to complete the program every three years. Certificates will be emailed to Daniella Jacobs as instructed below.
Public Reasoning Behind State Auditor 6-Month Assessment
In its response, Rocklin refers to a California Department of Education (CDE) Federal Program Monitoring review related to CHYA compliance. CDE conducted its review of Rocklin’s CHYA compliance after the completion of our audit and separate from our review. Auditors independently verified that Rocklin defined the frequency and content of its training program for teachers who provide CHYA instruction. Auditor also reviewed documentation Rocklin provided demonstrating that it was tracking compliance with the required training.
Recommendations to Sonoma Valley Unified School District
Recommendation 4
To improve compliance with CHYA, Sonoma should perform a detailed review of CHYA’s requirements and amend or supplement its instructional materials so that it addresses all required topics. Further, Sonoma should annually review the information in its instructional materials to ensure that it is accurate, up-to-date, and complies with any changes to state law.

Update: First, Kevin Covert is currently working with the Library Textbook Clerk Team to gather additional instructional materials to compare and contrast with our current approved instructional materials with Glencoe Health and Human Sexuality. Secondly, in the Spring of 2026, Kevin Covert will meet with teachers to review the CHYA requirements, review current instructional materials, preview other instructional materials as well as district pacing guides, in an effort to align our pacing guides with all current CHYA requirements. Additionally, the team will decide whether to continue with currently approved instructional materials and provide additional supplemental materials or move to completely new instructional materials for the Fall of 2026. Finally, each subsequent Spring semester, Kevin Covert will gather the teachers to review any changes to CHYA requirements and make adjustments to the instructional materials, supplemental materials and pacing guides as needed.

All teachers giving CHYA instruction will be trained prior to the start of each new school year. This training will take place over the summer or on days designated for professional development for teachers prior to the start of school.
Teachers will not be able to provide CHYA instruction, without first completing the annual training.
The content of the training will be based on the following:
- New and/or revised instructional materials and/or supplemental instructional materials.
- Current CHYA requirements, and any changes to CHYA requirements as they arise.
- Current and medically accurate information.
The training will be provided by:
- Instructional Material/Textbook company, or
- Local County Office of Education, or
- Assistant Superintendent of Curriculum, Technology, and Assessment, or
- Any combination of the previous three.
The Assistant Superintendent of Curriculum, Technology, and Assessment will work with Human Resources department to obtain an accurate list of teachers identified to teach CHYA curriculum, and track compliance with the required training.
Recommendations to Long Beach Unified School District

In order to ensure we are covering all instructional requirements of the CA Healthy Youth Act, we’ve developed additional slides for some lessons in our adopted curriculum.Regarding our supplemental materials, the State Auditor’s office indicated, “We reviewed these materials and found that they were responsive to the areas of noncompliance that we noted and that the district would better ensure CHYA-compliant instruction in the future by using these materials.” We will continue to review the legislation annually and update instructional materials as needed. These lesson resources were added to our curriculum materials beginning in October 2025.
Public Reasoning Behind State Auditor 60-Day Assessment
Long Beach provided us with a procedure which directs staff to perform an annual check each January for any new legislative requirements which may necessitate updates to Long Beach’s instructional materials or teacher training. Provided Long Beach continues to follow this procedure, it will continue to have fully implemented this recommendation.
Recommendation 7
To ensure that it complies with the training requirements in CHYA, Long Beach should review its teacher training program and modify the program as necessary to align with CHYA’s requirements.

We recently revised our curriculum to fully address CHYA requirements. Our next step is to revise our training so that it fully prepares teachers to deliver the revised content and to ensure that the training complies with the training requirements in CHYA. Our Spring 2025 training begins in March, so we’ll revise the content of the training prior to deploying training.
6-Month Agency Response
In our 60-day response, the District stated that we had revised our CHYA curriculum to fully address statutory requirements and would next revise our teacher training program to ensure alignment with Education Code section 51935 and to prepare teachers to deliver the revised content.
Since that time, the District has revised and expanded its CHYA training to more explicitly align with CHYA’s statutory requirements. Updated training sessions are scheduled for March 9, March 12, April 15, and April 17, 2026. Teachers who are new to CHYA instruction or due for retraining are required to attend one of these sessions.
The revised training includes:
- A detailed review of Education Code related to CHYA
- Explicit instruction on medically accurate, age-appropriate, objective, and inclusive standards
- Expanded guidance on LGBTQ+ inclusion and affirming diverse identities
- Clear direction on neutral, factual presentation of pregnancy and all legally available options
- Structured content on healthy relationships and abuse prevention
- Required supplemental lesson slides addressing identified gaps, including new menstruation requirements and updated content across lessons
- Explicit guidance that all approved lessons and supplements must be delivered as written
- Through these revisions and the Spring 2026 training cycle, the District has strengthened alignment between its teacher training program and CHYA requirements. The District will continue to monitor training completion through its CHYA tracking system to ensure ongoing compliance.
